REGISTRATION OF THE RIGHT TO INHERITANCE
The Constitution of Ukraine provides for the right of citizens to inherit property. The right of inheritance provides the opportunity to preserve and use the property of the testator.
The certificate of inheritance is one of those important documents that confirm your ownership of property.
There are two types of certificates of inheritance: by law and by will.
A CERTIFICATE OF INHERITANCE:
Most citizens have no idea what the intricacies are when registering, for example, an inherited apartment or house, not even knowing that it needs to be formalised in some way.
If a person or persons were mentioned in the will, they are entitled to inherit. If this document is invalidated, or if it is completely absent, the official paper does not specify the entire inheritance, or if the heirs refuse to accept the property, the right to inherit passes to the heirs in the order of priority determined by Articles 1261-1265 of the Civil Code of Ukraine.
Starting in 2016, the mandatory expert valuation of inherited property (regardless of its type) was cancelled when it comes to its receipt by the heirs of the first priority.
According to the law, each person in the queue is entitled to inherit real estate or any other property in the absence of heirs in the previous queue, refusal to accept, or deprivation of the right to inherit.
Documents required to obtain a Certificate of Inheritance:
An application by the heir to accept the inheritance (submitted at the last place of residence of the testator, within 6 months from the date of the testator's death).
Property documents (documents establishing the testator's ownership of the property, savings books, registered and securities, contracts, technical passports, land deeds, etc.)
Will, if any.
Death certificate of the testator.
A certificate of the last place of residence of the testator or a house book (issued by a housing office, village council, or other body).
A power of attorney (for persons acting by proxy).
Documents confirming family relations with the testator (birth certificate, marriage certificate).
Heirs and their passports, identification codes.
Expert valuation of the property, in case of taxation.
Regulatory and monetary valuation - for land plots (Vinnytsia City Council, 59 Soborna St., Transparent Office).
