PROVIDING EXTRACTS (INFORMATION REFERENCES)
The notary provides extracts (information certificates) from state and unified registers, namely: the state register of real rights to immovable property, the register of encumbrances on movable property, the state land cadastre, the state register of legal entities, individual entrepreneurs and public formations, the state register of registration of civil status acts, the inheritance register, etc.
PROVIDING EXTRACTS (INFORMATION REFERENCES)
Information from the State Register of Rights on the state registration of rights and their encumbrances is provided by the state registration authority, a notary in the form of an extract, information certificate and extract.
The notary is entitled by law to provide information from the State Register of Rights in the form of an extract or information certificate from the Register of Ownership Rights to Real Estate, the Unified Register of Prohibitions on Alienation of Real Estate and the State Register of Mortgages, in accordance with the procedure approved by the Resolution of the Cabinet of Ministers of Ukraine No. 722 dated 24.12.2014.
In the absence of information on registered real rights to immovable property in the State Register of Rights, a notary uses information on registered real rights from the Register of Ownership Rights to Immovable Property, on encumbrances of real rights from the Unified Register of Prohibitions on Alienation of Immovable Property and on mortgages from the State Register of Mortgages in respect of the object.
Information from the State Register of Rights is provided by a notary in paper form in the form of
an extract at the request of the owner or other right holder of the rights belonging to him/her, heirs (successors) of the respective persons, and the person in whose interests the encumbrance is established
information certificate;
in electronic form through the official website of the State Register in the form of an information certificate.
Who should receive the above extracts:
The owner of the immovable property or an authorised person (i.e. a person acting by power of attorney).
A person who has a real right.
An heir or an authorised person under a power of attorney.
Owner/co-owner of real estate.
Any individual or legal entity in case of receipt of an extract from the State Register of Rights on state registration of mortgage, encumbrance.
In order to obtain an extract from the State Register of Rights to Immovable Property, the following documents must be submitted to the notary:
Passport, identification code.
Title documents.
Power of attorney if necessary.
An agreement (transaction) confirming the existence of property rights of the subject of these rights.
Death certificate and documents confirming kinship with the testator.
Mortgage agreements, etc.
